Scope and Subject Matter

These Terms of Service govern the use of the application of Elwin Lovelace AG.

Technical Provider: In this phase, Elwin Lovelace AG merely provides the technical infrastructure for managing and analyzing contracts. Elwin Lovelace AG does not act as an insurance broker or agent and does not provide legal or insurance advice.

Beta Status (Work in Progress)

The user acknowledges that the software is in a beta phase (development stage).

• The software may contain errors, bugs, or inaccuracies.
• There is no entitlement to uninterrupted availability.
• Elwin Lovelace AG reserves the right to discontinue the service or change features at any time.

AI Functionality and Disclaimer (Hallucinations)

The app uses generative Artificial Intelligence (AI) for data extraction and answering questions (chat).

No Guarantee of Accuracy: Despite modern technology, the AI may generate false, incomplete, or misleading information (so-called "hallucinations"). Elwin Lovelace AG assumes no responsibility for the correctness of extracted data.

User's Duty to Verify: The user is obligated to compare all data and answers displayed by the app with their original contract before making legal or financial decisions (e.g., canceling a policy, switching providers). Relying on the app's information without verification is at the user's own risk.

User Obligations

The user warrants that they only upload contracts and documents to the app to which they are entitled (own contracts). Uploading contracts of third parties without their consent is prohibited.

Limitation of Liability

To the extent permitted by law, Elwin Lovelace AG's liability for direct and indirect damages, consequential damages, and data loss is excluded.

Liability for damages caused by gross negligence or intent of Elwin Lovelace AG remains reserved.

Final Provisions

Swiss law applies exclusively. Place of jurisdiction is Zurich.
